Aruba Activa

The Aruba Futura Foundation (Futura) is an Aruban foundation incorporated in accordance with the National Ordinance on Foundations (Landsverordening op Stichtingen) with the stated aim of supporting the Government of Aruba with the design and implementation of national innovation strategies, policies and initiatives and to manage, participate and/or execute innovation projects that would promote the innovation of the Aruban economy in the broadest sense.

The website Arubactiva.com (Arubaactiva) is wholly owned and operated by Futura with the intention of offering interested parties the opportunity of donating funds to support Futura with providing financial assistance to individuals, foundations, and companies with an existing of new project that are registered at Arubaactica for funds and with maintaining Arubaactiva.

By entering and using arubaactiva, user hereby agrees to the applicability of these Terms & Conditions to all the services provided in arubaactiva. If user does not agree to these Terms & Conditions, then user must discontinue using the services provided in this website. To the extent provided by law, this English version of these Terms & Conditions are binding, and any eventual translations shall be used for convenience only.

Futura reserves the right to change these Terms & Conditions at any given moment without any prior notice. Nevertheless, modified Terms & Conditions will be posted on this website and the date of last revision will be placed at the top of these Terms & Conditions.

You must be 18 years or older to sign up for and use the services on the arubaactiva website.

The information found on arubaactiva is for informational purposes only. This means that Futura does not guarantee the accuracy, completeness, reliability and/or relevance of such information or content. Therefore, the information found on arubaactiva must not be regarded as an advice from a professional party.

All decisions that are taken by the user in relation to the services that are offered on arubaactiva, independent of the fact that the decision was motivated by the information published on the website, will be considered to have been taken at the user’s own discretion and risk.

User can send an e-mail to Futura at hello@futuralab.org to request more information on the subjects found on the website or to report on information found on the website that can be considered to be misleading.

User acknowledges the existence of the risk that arubaactiva and the information found on the website may fall victim to hacking. This unlawful intervention could consist of but is not limited to, the removal and/or the alteration of existing information and/or the publishing of unauthorized information.

Futura will not be held liable for any damages that may result from the hacking of the website.

Futura reserves the right to change any information found on the website at any moment without prior notice.

On arubaactiva there are some links that user could use to visit websites that belong to third parties at their own discretion and risk. Futura does not control nor can be held responsible or liable for the content, services, legality, accuracy, relevance, reliability and/or any other aspect related to the website belonging to the third party.

User can donate at their own discretion and risk by providing the required personal information and by providing the required credit card information. All the information that is provided by user must be legal.

The donation cannot be higher than fifty thousand Aruban florins (Afl.50.000,00).

All donations will be done through CXPayTransactionGateway which is the program provided by CX Pay B.V. that will transfer the amount of funds that user wishes to donate to the account used by Futura for 100 innovations. CX Pay B.V. is PCI DSS (Payment Card Industry Data Security Standard) compliant.

The use of this service is heavily reliant on the degree to which an internet connection is stable, reliable, secure and functioning. Futura is not liable for any damage that is the result of an unstable, unreliable, insecure or otherwise non-functioning internet connection.

User acknowledges that arubaactiva and the different programs that or may be used for the various services that are offered on the website can fall victim to hacking. The hacking of the website and or its programs can result in situations that may cause damage to user.

Futura will not be held liable for any damage caused to user as a direct or indirect result of the hacking of the website and/or the programs

The donated funds will be used to support Futura with the provision of financial assistance to projects that are selected by Futura.

The selection of projects by Futura and the calculation of the amount of financial assistance that could be given to a project shall be done in accordance with a set of criteria that can be found on arubaactiva. These criteria can be modified by Futura and the modified version could only be applied to new registrants.

The fact that a project is selected does not mean that it would receive the financial assistance immediately. The provision and the amount of the financial assistance are dependent on the amount of donations that are received through arubaactiva. Futura will not be held liable for not providing the agreed upon to be raised amount of financial assistance due the having insufficient funds from donations.

The donations received by Futura via the platform will be disbursed to the accepted and registered applicants. Futura will divide the received donations equally among the accepted and registered applicants. The disbursement of the funds will take place on a bi-monthly basis. Each accepted and registered applicant will continue to receive a share of the funds until their desired funding amount is reached and never exceeding Afl. 5000,00.

The donated funds may be subject to local taxes and other fees. The fees in question are those that are associated with the transfer of funds between accounts and between countries and/or territories.

Therefore, taxes and/or other fees as previously mentioned, will be subtracted from the donated funds.

Arubaactiva contains creative works, signs and designs that are part of the intellectual property of Futura and/or partners. It is prohibited to reproduce and/or publish any creative work, sign and design that are found on arubaactiva and that are part of the intellectual property of Futura and/or partners without the written authorization of the rightful owner(s).

User hereby agrees to indemnify and hold harmless Futura, its subsidiaries and affiliated companies, and its officers, directors, employees, partners, contractors, representatives and agents from and against any and all claims, causes of action, damages, obligations, losses, liabilities, costs or debt, and expenses (including attorneys’ fees and costs) and all amounts paid in settlement arising from or related to breach of these Terms or violation of any applicable laws. Futura reserves the right, in its sole discretion, to assume the exclusive defense and control of any matter for which you have agreed to indemnify Futura and user hereby agrees to assist and cooperate with Futura as reasonably required in the defense or settlement of any such matter.

Your use of the services on this website is at your sole risk. The services are provided on an “as is” and “as available” basis. Futura and its affiliates expressly disclaim and exclude, to the fullest extent permitted by applicable law, all warranties, conditions and representations of any kind, whether express, implied or statutory, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

Futura and its affiliates make no warranty or condition that (I) the services will meet your requirements, (II) the services will be uninterrupted, timely, secure, or error-free, (III) the results that may be obtained from the use of the website or services will be accurate or reliable, or (IV) the quality of any products, services, information, or other material obtained by you through the website will meet your expectations. No advice or information (oral or written) obtained by you from Futura shall create any warranty.

To the fullest extent permitted by applicable law, neither Futura nor its affiliates will be liable under any theory of liability (whether in contract or tort) for any indirect, incidental, special, consequential, punitive, or exemplary damages, including damages for loss of revenues, profits, goodwill, use, data, or other intangible losses arising from or relating to the website or services of these Terms & Conditions.

The arubaactiva Privacy Policy forms part of these Terms & Conditions. By agreeing to these Terms, you also give your consent to the way we handle your personal information under that Privacy Policy.

Futura may terminate or block your access to all or any part of the website and its services at any time, with or without cause, with or without notice, effective immediately. All provisions of these Terms & Conditions shall survive termination, including but not limited to ownership provisions, warranty disclaimers, indemnity and limitations of liability.

The laws of Aruba apply to these Terms & Conditions and only the Court in First Instance of Aruba is competent to hear cases that may arise wherein provisions of these Terms & Conditions must be interpreted in light of the facts and arguments presented by Plaintiff.
